Memorandum by Mr. H. E. Pollock, K.C., Acting Attorney General on the Public Health Ordinance 1901 (13 of 1901).
As requested by the Right Honourable The Secretary of State for the Colonies in his Despatch, No. 183, of the 9th May, I now beg leave to report upon the Public Health Ordinance 1901, (13 of 1901), and, in the first place, I beg leave to express my regret that there should have been some delay in dealing with this matter, in consequence of the fact that the Ordinance in question was prepared and passed by Mr. Goodman and not by me and consequently I was not familiar with its component parts.
I now beg leave to submit a copy of the Ordinance, with marginal notes upon it in red ink, showing (i) What were the corresponding provisions of the Repealed Ordinances, and (ii) The reasons for certain alterations effected in the law.
I also beg leave to forward a Table which I hope will prove useful, namely, a Table showing how the provisions of the different Ordinances, which are repealed by section 2 (1) and Schedule 4 of Ordinance 13 of 1901 are accounted for.
It seems to me necessary to make a few additional observations.
As regards the definition of the City of Victoria in section 3, the language of this definition, which is borrowed from the Rating Ordinance, 15 of 1888, has been modified owing to the fact that the skew-bridge is now no longer in existence.
The actual boundaries, however, as defined by this Ordinance, exactly correspond with the boundaries as defined
